OFFICIAL CONTEST RULES AND REGULATIONS<\/p>\n

By participating in the “Olé Cocktail Co. Maddle Paddle Board Giveaway” Contest (the “Contest”), you are signifying your agreement that you have read and agree to be legally bound by these official contest rules and regulations (the “Rules”). The decisions of Mark Anthony Group Inc., a BC company, (the “Sponsor”) with an office at 1209 King Street West, Unit 200, Toronto, ON M6K 1G2, with respect to all aspects of the Contest are final and binding.<\/strong><\/p>\n

  1. CONTEST PERIOD.<\/strong> The Contest begins at 12:00:01 am Eastern Time (“ET”) on September 8, 2025 and ends at 11:59:59 pm ET on September 17, 2025 (the “Contest Period”). Entries submitted before or after the Contest Period will not be eligible. Sponsor’s computer or networking equipment is the official time-keeping device for the Contest.<\/li>\n<\/ol>\n
      \n
    1. ELIGIBILITY.<\/strong> To enter the Contest and be eligible for a chance to win a prize a person (the “Entrant”) must be a legal resident of Canada who have reached the legal drinking age in their province or territory of residence at the time of entry. Persons are not eligible to enter if they: a) are an employee, director, representative, agent or officer of the Sponsor, its parent companies, subsidiaries, affiliates, advertising or promotional agencies, prize suppliers, or any other individual or entity involved in the development, production, administration or fulfillment of the Contest (collectively the “Contest Parties”); b) are an employee of or contractor to any provincial liquor authority or any participating licensed establishment; or c) are a member of the immediate family (defined as parents, siblings, children, spouse and life partner, regardless of where they live) or household (whether related or not) of any of the above-referenced persons.<\/li>\n<\/ol>\n

      1. HOW TO ENTER:<\/strong> No Purchase Necessary.<\/strong> A purchase will not improve your chances of winning. Internet access and an active Instagram account required. Online entry through Instagram only; no other means of submission will be accepted.<\/li>\n<\/ol>\n

        To enter via Instagram:<\/strong><\/p>\n

        • At or near the beginning of the Contest Period, the Sponsor or its designated representative will post one (1) Contest-related post (the “Contest Post”) at www.instagram.com\/olecocktails (the “Instagram Contest Page”);<\/li>\n
        • To enter, you must log in to your Instagram account (or create an account at www.instagram.com), visit the Instagram Contest Page during the Contest Period, locate the Contest Post and complete the steps below:<\/li>\n
        • Like the Contest Post<\/li>\n
        • Follow the page Olé Cocktail Co. (@olecocktails) and Maddle (@maddleboards)<\/li>\n
        • In the comments section of Contest Post, include the hashtag #ContestEntry and tag at least one (1) friend who is at least 19 years of age

          Once you have completed all of the foregoing steps to enter (as determined by the Sponsor in its sole and absolute discretion), you will be eligible to receive an entry (an “Entry”).

          Entries: To be eligible, all entry elements associated with your Entry and\/or the Entrant’s account must: (i) be publicly shared; (ii) not be deleted or altered during the Contest Period; (iii) be submitted and received in accordance with these Rules during the Contest Period; (iv) includes all required components\/elements required in Rule 3; (v) be in accordance and compliant with these Rules; and (vi) be in accordance and compliant with the applicable terms, rules, policies and guidelines of Instagram (the “Instagram Rules”).

          Entry Limit: You may enter the Contest more than once provided that no one (1) person is tagged by you in more than one Entry. For clarity, each comment counts as one (1) entry, regardless of how many friends are tagged. Only one (1) tagged friend per comment will be considered. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits stated in these Rules; (ii) use multiple names, identities, e-mail addresses, and\/or Instagram accounts; (iii) use any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; and\/or (iv) disrupt or participate in the Contest in any other fraudulent, abusive, deceptive, unfair or misleading way; then the Entrant may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. An Entry may be rejected if (in the sole and absolute discretion of the Sponsor): (i) the Entry is not submitted and received in accordance with these Rules or Instagram Rules during the Contest Period; and\/or (ii) the Entry is not otherwise in compliance with these Rules or Instagram Rules (all as determined by Sponsor in its sole and absolute discretion).

          Standard message and data rates may apply to participants who choose to participate in the Contest through a mobile device or other electronic devices. Please contact your service provider for pricing and service plan information and rates before any mobile or electronic device participation.<\/li>\n<\/ul>\n

          1. Alcohol is not part of the prize.<\/strong> There will be one (1) Prize (the “Prize”). The Prize consists of: one (1) Maddle Signature Paddle Board in The Free Spirit color and three (3) flats of OLÉ mocktails (the selection of mocktail flavors is subject to availability at the time of prize fulfillment). The Prize is provided by the Sponsor. The approximate retail value (“ARV”) of the Prize is seven hundred Canadian dollars ($700 CAD).

            There is a limit of one (1) Prize per person. No more than the advertised number of prizes will be awarded. The Prize will only be released to the verified winner. Arrangements for Prize delivery will be confirmed with the potential winner by e-mail, telephone or Instagram (direct message or tagged post). Return of any prize\/prize notification as undeliverable may result in disqualification and selection of an alternate winner.

            Without limiting the foregoing, the following terms and conditions apply to the Prize, as applicable: (i) Prize must be accepted as awarded and is not transferable, assignable and\/or convertible to cash, another prize or otherwise (except as may be specifically permitted by Sponsor in its sole and absolute discretion); (ii) no substitutions are permitted, except at Sponsor’s option; (iii) the costs of everything not specifically and expressly stated above as included in the Prize are the sole and absolute responsibility of the potential winner, including without limitation, airline baggage fees, gratuities, meals, transportation, personal expenses of any kind or nature, federal, provincial and local taxes, room taxes and other hotel fees, charges and\/or fees arising from changes, and any other incidental costs or expenses; (iv) if the potential winner (and as applicable, their guest(s)) does not utilize any part(s) of the Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (v) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Prize or any component thereof; and (b) substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsor’s sole and absolute discretion, a cash award; (vi) neither Sponsor nor any of its prize providers will replace any lost, stolen or destroyed tickets, gift cards, promotional cards or vouchers; (vii) any difference between the actual value of a Prize and its stated ARV will not be awarded (including, as applicable and without limitation, the point of departure and fluctuations in the cost of air transportation); (viii) Prize may not be exactly as shown in promotional materials; (ix) by accepting the Prize, the potential winner (and as applicable, their guest(s)) agrees to waive all recourse against the Sponsor and all of the other Released Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part; (x) if the Prize includes guest(s), guest(s) must be at least 19 years of age; and (xi) by participating in a Prize or any portion thereof, the potential winner (and as applicable, their guest(s)): (a) signifies that they understand, acknowledge and accept that participation in the Prize may involve danger and\/or exposure to risks and hazards (including without limitation as may be due to the inherent risks of travel and as may be due to possible COVID-19 exposure or infection), whether arising from foreseeable or unforeseeable human error and negligence, and that, as a result, they may suffer damage to personal property, serious personal injury, illness or even death; (b) signifies that they acknowledge and agrees that the Released Parties (as defined below) have not made any warranties, guarantees or representations about their safety while participating in the Prize.

            The Released Parties (as defined below) are not responsible for any delay, postponement, suspension, rescheduling or cancellation, for any reason (including, without limitation, due to illness or health risks, or any governmental or health authority orders, measures, directives or guidance in response to such illness or risks, such as, without limitation, those that may be implemented to mitigate COVID-19 transmission, or due to any other cause of any kind or nature whatsoever), of any aspect of the Prize. Neither the potential winner (and as applicable, their guest(s)) nor any other person or entity will be compensated in the event of such delay, cancellation or other event contemplated herein. The potential winner (and as applicable, their guest(s)) will be solely responsible for complying with any and all COVID related and other protocols – including, but not limited to, mandatory vaccination, testing and\/or screening requirements.

            None of the Released Parties (as defined below) makes any representation or offers any guarantee or warranty, express or implied, in fact or in law, as to the quality, authenticity, merchantability, mechanical condition or fitness of any prizes awarded in connection with the Contest. To the fullest extent permitted by applicable law, the potential winner understands and acknowledges that they may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsor or any of the other Released Parties should the Prize fail to be fit for its purpose or is in any way unsatisfactory.

            By entering this Contest and accepting the Prize, the potential winner agrees to maintain their (and as applicable, their guest(s)) behaviour in accordance with all applicable laws and generally accepted social practices in connection with participation in any Contest-related or Prize-related activity. The potential winner understands and agrees that Sponsor, or prize providers have the right, in their sole discretion, to disqualify and remove the potential winner (and as applicable, their guest(s)) from any activity at any time if the potential winner (and as applicable, theirs guest(s)) behaviour at any point is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of any Contest-related party or otherwise violates the policies of the prize providers, and in such a case, the potential winner will still be solely responsible for all expenses related to the Prize.<\/li>\n<\/ol>\n
              \n
            1. WINNER SELECTION:<\/strong> A random draw will be conducted from all eligible Entries submitted and received in accordance with these Rules during the Contest Period to select one (1) eligible entrant on or around September 19, 2025 (the “Selection Date”) at 1209 King Street West, Unit 200, Toronto, ON M6K 1G2 by the Sponsor or its designated representative(s), and such selected entrant(s) will be deemed the potential winner(s).

              The odds of winning depend on the number of eligible Entries submitted and received in accordance with these Rules during the Contest Period.<\/li>\n<\/ol>\n
                \n
              1. WINNER NOTIFICATION PROCESS.<\/strong> The Sponsor or its designated representative will make a minimum of three (3) attempts to contact the potential winner (using the information provided at the time of entry) within three (3) business days of the Selection Date. If the potential winner cannot be contacted within three (3) business days of the Selection Date, or if there is a return of any notification as undeliverable; then the potential winner may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select an alternate potential winner following the same winner selection procedure described above (with the necessary amendments), in which case the foregoing provisions of this section shall apply to such new potential winner. No communication will be entered into by the Sponsor with entrants except with selected entrants. The Sponsor is not responsible for the failure, for any reason whatsoever, of a selected entrant to receive notification or for the Sponsor to receive a selected entrant’s response.<\/li>\n<\/ol>\n
                  \n
                1. WINNER CONFIRMATION PROCESS.<\/strong> BEFORE BEING DECLARED THE CONFIRMED PRIZE WINNER, the potential winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor, be administered online, by e-mail or other electronic means, by telephone, or in the Sponsor’s form of declaration and release); and (b) sign and return within five (5) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize (as awarded); (iii) releases the Contest Parties and each of their respective successors and assigns, any provincial liquor authorities and any participating licensed establishments (collectively, the “Released Parties”) from any and all liability, directly or indirectly, in connection with this Contest, including without limitation use of the potential winner’s Contest-related information (or any portion thereof), their participation therein, the awarding, receipt, possession or use\/misuse of the Prize or any portion thereof, and\/or their violation or infringement of any intellectual property rights or of any publicity, personality or privacy rights, or infringe on any rights and\/or interests of any third party; and (iv) agrees to the publication, reproduction and\/or other use of the potential winner’s name or other likeness without further notice or compensation, in perpetuity throughout the world, in any publicity or advertisement carried out by or on behalf of the Sponsor. This release shall continue in force following the termination of the Contest and\/or awarding of any prize. Where applicable, potential winner’s guest(s) may also, at the discretion of the Sponsor, be required to properly execute Contest documents within the specified time as a condition of participation in a Prize or any portion thereof, and such release shall continue in force following the termination of the Contest and\/or the guest(s) participation in a Prize or any portion thereof, and such release shall continue in force following the termination of the Contest and\/or the guest(s) participation in a Prize or any portion thereof.

                  If a potential winner: (a) fails to return the properly executed Contest documents within the specified time; (b) fails to correctly answer the skill-testing question; (c) cannot accept (or is unwilling to accept) the Prize (as awarded) for any reason; (d) at any stage supplied untruthful, incomplete, inaccurate or misleading information (as determined by the Sponsor in its sole and absolute discretion); and\/or (e) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then the potential winner will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate potential winner in accordance with the winner selection procedure described above (in which case the foregoing provisions of this section shall apply to such newly selected potential winner).<\/li>\n<\/ol>\n

                  GENERAL RULES<\/strong><\/p>\n

                  1. The provincial liquor agencies are not in any way associated with this Contest nor are they liable in any way whatsoever in regard to any matter which relates to this Contest.<\/li>\n<\/ol>\n

                    1. The Contest is in no way sponsored, endorsed or administered by, or associated with Instagram. You understand that you are providing your information to the Sponsor and not to Instagram. The information you provide will only be used to administer the Contest in accordance with the Sponsor’s privacy policy. Instagram is completely released of all liability by each Entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not Instagram.<\/li>\n<\/ol>\n
                        \n
                      1. The Contest is governed by the laws of Canada and the Province of BC and each Entrant in the Contest hereby consents to the exclusive jurisdiction of the laws of BC for any causes or controversies arising out of the Contest. Each Entrant waives any and all objections to jurisdiction and venue in these courts.<\/li>\n<\/ol>\n
                          \n
                        1. All Entries become the property of the Sponsor. This Contest is void where prohibited and is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility\/disqualification of Entries and\/or entrants. ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.<\/li>\n<\/ol>\n
                            \n
                          1. By entering this Contest, each Entrant agrees to abide by and be bound by these Rules and to save and hold harmless the Sponsor and the other Released Parties from any and all liability for harm which the potential winner may suffer as a result of participation in the Contest, compliance or non-compliance with these Rules and acceptance, use or misuse of the Prize, and each selected potential winner agrees to sign the Sponsor’s declaration and release documents (see Rule 7 above) in this regard before receiving their Prize. The Released Parties shall not bear any liability arising from or in any way relating to the Contest or the Prize awarded.<\/li>\n<\/ol>\n
                              \n
                            1. All Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and\/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an entrant’s eligibility to participate in this Contest; (ii) for the purposes of verifying the accuracy and\/or legitimacy of any Entry, or other information entered (or purportedly entered) for the purposes of this Contest; and\/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the letter and spirit of these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor.<\/li>\n<\/ol>\n

                              1. Entries may not be given or sold to anyone else, and the Sponsor reserves the right to refuse to accept the registration of an entry if the Sponsor considers the entry to have been submitted by an ineligible person or through the use of any automated, macro, script, robotic or other system(s) or program(s). All Entrants must prove their eligibility with valid photo identification and proof of residency, upon request.<\/li>\n<\/ol>\n

                                1. In the event of a dispute regarding who submitted an Entry, the Sponsor reserves the right, in its sole and absolute discretion, to require any individual who purports to be the entrant that submitted the Entry in question to provide proof to the complete satisfaction of the Sponsor (as determined by the Sponsor in its sole and absolute discretion) of being the entrant that submitted such Entry. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification (as determined by the Sponsor in its sole and absolute discretion).<\/li>\n<\/ol>\n

                                  1. Sponsor reserves the right, at its sole and absolute discretion to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, without limitation, any error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud or technical failure, and if applicable, subject to approval from any provincial liquor authority. The Sponsor, at its sole and absolute discretion reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. Without limiting the generality of the foregoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and\/or to comply with applicable law. The Sponsor reserves the right, at its sole and absolute discretion to adjust any of the dates, timeframes and\/or other Contest mechanics stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.<\/li>\n<\/ol>\n

                                    1. No responsibility is assumed by the Sponsor and the other Released Parties for any inability of a potential entrant to successfully enter the contest for any reason. The Released Parties will not be liable for: (i) any failure of any website during the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; and\/or (v) any combination of the above. Without limiting the generality of the foregoing, by participating in the Contest, each entrant releases the Released Parties from any and all liability in connection with this Contest and their participation therein.<\/li>\n<\/ol>\n

                                      1. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.<\/li>\n<\/ol>\n

                                        1. By entering this Contest, each entrant expressly consents to the Sponsor, its agents and\/or representatives, storing, sharing and using the personal information submitted with their Entry only for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy (available at: https:\/\/olecocktails.com\/privacy-policy\/).This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and\/or disclosure of their personal information.<\/li>\n<\/ol>\n

                                          1. In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, the Website, point of sale, television, print or online advertising and\/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law, unless otherwise determined by the Sponsor, in its sole and absolute discretion.<\/li>\n<\/ol>\n

                                            1. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.<\/li>\n<\/ol>\n

                                              1. For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.<\/li>\n<\/ol>\n

Sont exclus du concours : (a) les employés, administrateurs, représentants, agents ou dirigeants du commanditaire ou de l’une de ses sociétés affiliées ou apparentées, ou de l’une de ses agences de publicité ou de promotion, ou de l’organisme de supervision du concours, ou du fournisseur de prix, et toute autre personne ou entité impliquée dans le développement, la production, l’administration ou l’exécution du concours; (b) les employés et agents contractuels des régies des alcools provinciales et des établissements licenciés participants; et (c) les membres de la famille immédiate (c.-à-d. les parents, les frères et sœurs, les enfants, le conjoint ou le partenaire de vie, peu importe leur lieu de résidence) ou du ménage (qu’il y ait un lien de parenté ou non) des personnes susmentionnées.<\/li>\n<\/ol>\n

                                                    1. PÉRIODE DU CONCOURS. <\/strong>Le concours débute le 8 septembre 2025 à 00 h 00 min 01 s (heure de l’Est) et prend fin le 17 septembre  à 23 h 59 min 59 s (heure de l’Est) (la « période du concours »). Les participations soumises avant ou après la période du concours ne seront pas admissibles. Le parc informatique ou l’équipement réseau du commanditaire est l’appareil de chronométrage officiel du concours.<\/li>\n<\/ol>\n

                                                      1. COMMENT PARTICIPER. Aucun achat requis. <\/strong>Un achat n’augmente pas les chances de gagner. Un accès Internet et un compte Instagram sont requis. La participation se fait uniquement en ligne sur Instagram; aucun autre moyen de participation ne sera accepté.<\/li>\n<\/ol>\n

                                                          • Aimer la publication du concours.<\/li>\n
                                                          • Dans la section des commentaires de la publication du concours, incluez le mot-clic #ContestEntry<\/strong> ou #ParticipationConcours et identifiez au moins un (1) ami âgé d’au moins 19 ans.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n
                                                              \n
                                                            • Lorsque toutes les étapes ont été faites, le participant est automatiquement admissible à une (1) participation (une « participation ») au concours.

                                                              Il est possible de participer au concours plus d’une fois, à condition de ne pas identifier le même ami dans plus d’une participation.<\/li>\n<\/ul>\n

                                                                Une même personne ne peut s’inscrire à partir de deux ou plusieurs comptes Instagram différents, et deux personnes ne peuvent s’inscrire à partir du même compte Instagram.

                                                                Le commanditaire et les autres parties exonérées (telles que définies ci-dessous) ne seront pas responsables des participations illisibles, falsifiées, endommagées, perdues, envoyées au mauvais destinataire, mutilées, indéchiffrables, incomplètes ou tardives, qui seront annulées. Il est interdit d’utiliser des dispositifs automatisés. Le participant pourra être disqualifié du concours, à la seule discrétion du commanditaire, si ce dernier découvre (à l’aide d’une preuve ou d’une information mise à sa disposition ou autrement) qu’une personne a tenté : (i) d’utiliser plusieurs noms, identités, adresses électroniques, adresses IP, comptes Instagram; (ii) d’utiliser tout système ou programme automatisé, macro, script, robot ou autre pour participer ou perturber le concours; (iii) de télécharger du contenu inapproprié; (iv) de participer ou de perturber le concours de toute autre manière frauduleuse ou trompeuse; ou (v) de participer contrairement au présent règlement ou au règlement Instagram. Tout participant qui publie de multiples mises à jour, commentaires ou photos sans lien avec le concours peut être disqualifié du concours. Seules les participations admissibles reçues pendant la période du concours donneront lieu à une participation au concours.<\/li>\n<\/ol>\n
                                                                  \n
                                                                1. PRIX.<\/strong> Il y a un (1) prix à gagner. Il comprend les éléments suivants (ensemble, le « prix ») :<\/li>\n<\/ol>\n

                                                                    Le prix est fourni par le commanditaire. La valeur au détail approximative du prix est de cent dollars canadiens (700$ CA). Le nombre de prix attribué ne dépassera pas le nombre indiqué. Le prix n’est pas transférable, doit être accepté tel quel et ne peut être échangé contre de l’argent, un autre prix ou autre (sauf à la seule discrétion du commanditaire). Le commanditaire se réserve le droit, pour quelque raison que ce soit, à son entière discrétion, d’attribuer un prix de rechange d’une valeur monétaire égale ou supérieure si le prix ne peut être attribué tel qu’il est décrit. Le prix sera attribué uniquement au gagnant dont l’identité aura été vérifiée. Tous les frais et dépenses accessoires qui ne sont pas explicitement mentionnés dans le présent règlement, y compris (sans s’y limiter) les taxes fédérales, provinciales et locales, relèvent de la responsabilité du gagnant du prix. Les modalités de livraison du prix seront confirmées avec le gagnant par courriel ou par téléphone. Si un prix ou un avis de prix est retourné avec la mention « non distribuable », le participant sélectionné pourrait être disqualifié et, le cas échéant, un autre gagnant sera choisi.

                                                                    Aucune des parties exonérées (telles que définies ci-dessous) ne fait de déclaration ni n’offre de garantie, expresse ou tacite, quant à la qualité ou à l’adaptation à un usage particulier du prix attribué dans le cadre du concours. Dans toute la mesure permise par la loi applicable, le gagnant comprend et reconnaît qu’il ne peut pas demander de remboursement ou exercer un recours légal ou en equity auprès du commanditaire ou de l’une des autres parties exonérées si le prix n’est pas adapté à un usage particulier ou s’il est insatisfaisant de quelque manière que ce soit.<\/li>\n<\/ol>\n

                                                                    1. SÉLECTION DES GAGNANTS. <\/strong>Un tirage au sort sera effectué parmi toutes les participations admissibles reçues pendant la période du concours afin de sélectionner une (1) participation le ou vers le 19 septembre 2025 à OLÉ COCKTAIL CO. ®<\/sup> 1209 King Street West, local 200, Toronto (Ontario) M6K 1G2 par le commanditaire. Le commanditaire ou ses représentants désignés (les « superviseurs du concours ») tenteront de contacter chaque participant sélectionné sur Instagram (message direct ou identification dans une publication) ou par courriel dans les deux (2) jours ouvrables suivant la date du tirage. Si un participant sélectionné est impossible à contacter dans le délai imparti, il n’est plus admissible pour gagner le prix et les superviseurs du concours peuvent, à leur seule discrétion, sélectionner au hasard un autre participant admissible, qu’ils tenteront de contacter, et qui devra à son tour respecter les mêmes conditions, à défaut de quoi il sera disqualifié. Les chances de gagner dépendent du nombre total de participations admissibles reçues pendant la période de concours.<\/li>\n<\/ol>\n

                                                                      1. EXONÉRATION DE RESPONSABILITÉ ET QUESTION RÉGLEMENTAIRE.<\/strong> Afin d’être déclaré gagnant, le gagnant potentiel doit répondre correctement, sans aide mécanique ou autre, à une question réglementaire d’arithmétique; remplir le formulaire de déclaration de conformité au règlement ainsi qu’une exonération de responsabilité et un consentement à des fins publicitaires (le « formulaire de déclaration, d’exonération et de consentement ») et le retourner dûment signé dans les cinq (5) jours ouvrables suivant leur remise par le commanditaire, confirmant (entre autres) la conformité au règlement et dégageant le commanditaire, ses agences de publicité ou de promotion, tout organisme de supervision du concours, les régies des alcools provinciales, les fournisseurs de prix ainsi que les sociétés mères et affiliées des entités susmentionnées et tous leurs administrateurs, dirigeants, propriétaires, partenaires, employés, agents, représentants, successeurs et ayants droit respectifs (ensemble, les « parties exonérées ») de toute responsabilité en lien avec le concours ou résultant (i) de la participation au concours; (ii) de l’acceptation du prix tel qu’il a été attribué; et (iii) de l’administration du concours et de la distribution du prix attribué de la façon décrite dans le présent règlement. Le gagnant autorise irrévocablement le commanditaire à diffuser et publier son nom, son adresse, sa photographie, sa ressemblance ou toute autre image, sa voix ou ses déclarations, dans le cadre de toute publicité ou promotion – commerciale ou autre – ou à des fins de nouvelles générales, de divertissement, de marketing ou d’information, dans tous les médias, sans compensation d’aucune sorte (autre que le prix) ni autre préavis. Aucun participant ne sera déclaré gagnant avant la vérification de sa conformité au présent règlement. Le formulaire de déclaration, d’exonération et de consentement doit être retourné dûment signé dans le délai indiqué sur le formulaire ou à la demande du commanditaire ou de son représentant, sans quoi le prix sera considéré avoir été abandonné.

                                                                        Si un gagnant potentiel (a) ne répond pas correctement à la question réglementaire; (b) ne peut pas accepter (ou ne veut pas accepter) le prix (tel qu’il est attribué) pour quelque raison que ce soit; ou (c) est considéré comme étant en infraction au présent règlement (le tout tel que déterminé par le commanditaire à sa seule discrétion), il sera disqualifié (et perdra tous ses droits au prix) et le commanditaire se réserve le droit, à sa seule discrétion et si le temps le permet, de sélectionner au hasard un autre gagnant potentiel parmi toutes les autres participations admissibles soumises et reçues conformément à l’article 6 du présent règlement (auquel cas les dispositions précédentes de cette section s’appliqueront à ce nouveau gagnant potentiel sélectionné).<\/li>\n<\/ol>\n

                                                                        DISPOSITIONS GÉNÉRALES<\/strong><\/p>\n

                                                                        1. Les régies des alcools provinciales ne sont aucunement associées au concours ni responsables de toute question relative au concours.<\/li>\n<\/ol>\n

                                                                          1. Le concours n’est aucunement commandité, appuyé ou administré par Instagram, ni associé à Instagram. Le participant convient qu’il fournit ses renseignements au commanditaire, et non à Instagram. Les renseignements fournis ne seront utilisés que pour administrer le concours conformément à la politique de protection de la vie privée du commanditaire. Le participant au concours dégage entièrement Instagram de toute responsabilité. Toute question, remarque ou plainte concernant le concours doit être adressée au commanditaire, et non à Instagram.<\/li>\n<\/ol>\n

                                                                            1. Le concours est régi par les lois du Canada et de la province de la Colombie-Britannique, et le participant accepte par la présente la juridiction exclusive des lois de la Colombie-Britannique pour les causes ou litiges découlant du concours. Le participant renonce à toute objection concernant la juridiction et la compétence de ces tribunaux.<\/li>\n<\/ol>\n

                                                                              1. En s’inscrivant au concours, le participant accepte de dégager le commanditaire et les autres parties exonérées de toute responsabilité en cas de préjudice au gagnant découlant de la participation au concours, du respect ou non-respect du présent règlement et de l’acceptation, de l’utilisation ou de la mauvaise utilisation du prix, et le participant sélectionné accepte de signer le formulaire de déclaration, d’exonération et de consentement du commanditaire (voir article 8 ci-dessus) à cet égard avant de recevoir son prix. Les parties exonérées se dégagent de toute responsabilité se rattachant au concours ou au prix attribué.<\/li>\n<\/ol>\n

                                                                                1. Toutes les participations et tous les participants peuvent faire l’objet d’une vérification en tout temps et pour toute raison. Le commanditaire se réserve le droit, à sa seule discrétion, d’exiger une preuve d’identité et\/ou d’admissibilité (sous une forme acceptable pour le commanditaire – y compris, sans s’y limiter, une pièce d’identité avec photo émise par le gouvernement) : (i) dans le but de vérifier l’admissibilité d’une personne à participer à ce concours; (ii) dans le but de vérifier l’exactitude ou la légitimité de toute participation ou de toute autre information soumise (ou prétendument soumise) aux fins du concours; ou (iii) pour toute autre raison que le commanditaire juge nécessaire, à sa seule discrétion, dans le but d’administrer le concours conformément à la lettre et à l’esprit du présent règlement. Le fait de ne pas fournir dans le délai imparti une telle preuve à l’entière satisfaction du commanditaire peut entraîner la disqualification du participant, à la seule discrétion du commanditaire.<\/li>\n<\/ol>\n

                                                                                  1. Il est interdit de donner ou de vendre des participations, et le commanditaire se réserve le droit de refuser une participation s’il considère qu’elle a été soumise par une personne inadmissible ou au moyen d’un système ou programme automatisé, macro, script, robot ou autre. Le participant doit prouver son admissibilité à l’aide d’une pièce d’identité avec photo valide et d’une preuve de résidence, sur demande.<\/li>\n<\/ol>\n

                                                                                    1. En cas de contestation de l’identité d’un participant\/gagnant, la personne au nom de laquelle le compte de courriel ou le compte Instagram applicable est enregistré sera réputée être le participant\/gagnant. Seuls le parc informatique ou l’équipement réseau seront considérés comme une source digne de foi pour déterminer l’heure de réception d’une participation admissible au concours.<\/li>\n<\/ol>\n

                                                                                      1. Toutes les décisions du commanditaire ou d’autres parties chargées d’administrer le concours, qui peuvent être des employés du commanditaire ou de ses filiales ou des contractuels indépendants, sont définitives et exécutoires à tous les égards du concours, y compris, sans s’y limiter, l’admissibilité ou la disqualification des participations. Toutes les participations deviennent la propriété du commanditaire.<\/li>\n<\/ol>\n

En s’inscrivant au concours, le participant accepte de se conformer au règlement du concours et à la politique de protection de la vie privée du commanditaire, qui se trouve à https:\/\/ca.whiteclaw.com\/fr\/privacy\/. AVERTISSEMENT : <\/strong>TOUTE TENTATIVE DÉLIBÉRÉE DE LA PART D’UN PARTICIPANT OU DE TOUTE AUTRE PERSONNE D’ENDOMMAGER UN SITE WEB OU DE SABOTER LE DÉROULEMENT LÉGITIME DU CONCOURS PEUT CONSTITUER UNE INFRACTION CIVILE ET PÉNALE, ET LE COMMANDITAIRE SE RÉSERVE LE DROIT D’INTENTER UNE POURSUITE EN DOMMAGES-INTÉRÊTS CONTRE TOUTE PERSONNE RESPONSABLE D’UNE TELLE TENTATIVE, DANS LA MESURE OÙ LA LOI LE PERMET.<\/li>\n<\/ol>\n

                                                                                          1. Le commanditaire se réserve le droit d’annuler ou de modifier le concours s’il décide, à sa seule discrétion, qu’une fraude ou un autre facteur compromet l’intégrité du concours. Sans limiter la portée générale de ce qui précède et sous réserve de l’autorité de la Régie des alcools, des courses et des jeux du Québec, et de l’approbation d’une régie des alcools provinciale, au besoin, le commanditaire se réserve le droit, à sa seule discrétion, d’annuler en tout ou en partie, de modifier ou de suspendre le concours ou le présent règlement, de quelque manière que ce soit, sans préavis ni obligation, en cas de cause indépendante du contrôle raisonnable du commanditaire qui contreviendrait au bon déroulement du concours, tel qu’il est décrit dans le présent règlement, y compris, sans s’y limiter, une erreur d’impression, une erreur administrative, technique ou autre, un problème, un virus informatique, un bogue, un trafiquage, une intervention non autorisée, une fraude, une défaillance ou toute autre cause, s’il le juge approprié en fonction des circonstances ou pour se conformer à la loi, aux règlements ou à d’autres exigences applicables. Les décisions du commanditaire concernant tous les aspects du concours sont définitives et exécutoires pour tous les participants, sans droit de recours, y compris, sans s’y limiter, toute décision concernant l’admissibilité\/la disqualification des participations. Le commanditaire se réserve également le droit de modifier la période du concours, à sa seule discrétion, sous réserve des exigences relatives aux avis applicables.<\/li>\n<\/ol>\n

                                                                                            1. En cas de divergence ou de contradiction entre le présent règlement et les communications ou autres déclarations contenues dans tout matériel lié au concours, y compris, sans s’y limiter, les publicités diffusées dans les points de vente, à la télévision, en format papier ou en ligne ou toute instruction ou interprétation relative au présent règlement de la part d’un représentant du commanditaire, les modalités du présent règlement prévaudront, régiront et auront préséance dans toute la mesure permise par la loi, à moins que le commanditaire n’en décide autrement, à sa seule discrétion.<\/li>\n<\/ol>\n

                                                                                              1. La nullité ou l’inapplicabilité d’une disposition du présent règlement ne pourra compromettre la validité ni la force exécutoire des autres dispositions. Si une disposition du règlement est déclarée non valide ou autrement inapplicable ou illégale, le présent règlement reste en vigueur et doit être interprété selon ses conditions comme si la disposition non valide ou illégale n’en faisait pas partie.<\/li>\n<\/ol>\n

                                                                                                1. En s’inscrivant au concours, le participant consent à l’utilisation de ses renseignements personnels par le commanditaire ou ses agents de promotion à des fins d’administration du concours, de même qu’à l’utilisation de tous les renseignements personnels recueillis par le commanditaire (y compris ceux recueillis auprès des participants sélectionnés dans le cadre de l’attribution du prix) conformément à la politique de protection de la vie privée du commanditaire, qui se trouve à https:\/\/ca.whiteclaw.com\/fr\/privacy\/.<\/li>\n<\/ol>\n

                                                                                                  1. Le commanditaire et les autres parties exonérées n’assument aucune responsabilité en cas de participations perdues, tardives, incomplètes, indéchiffrables, non livrées, endommagées ou envoyées au mauvais destinataire, ou en cas de problèmes techniques de quelque nature que ce soit affectant le déroulement ou l’administration du concours, y compris, sans s’y limiter, toute défaillance ou panne techniques ou tout autre problème du matériel informatique ou des logiciels, du réseau ou des lignes téléphoniques ou d’une diffusion pendant la période du concours. Les parties exonérées ne seront pas responsables des dommages subis par l’ordinateur du participant ou de toute autre personne résultant de la participation au concours ou du téléchargement de tout matériel.<\/li>\n<\/ol>\n
                                                                                                      \n
                                                                                                    1. Le concours est nul là où la loi l’interdit et assujetti à toutes les lois fédérales, provinciales et municipales.<\/li>\n<\/ol>\n

                                                                                                      1. Pour les résidents du Québec : Un différend quant à l’organisation ou à la conduite d’un concours publicitaire peut être soumis à la Régie des alcools, des courses et des jeux afin qu’il soit tranché. Un différend quant à l’attribution d’un prix peut être soumis à la Régie uniquement aux fins d’une intervention pour tenter de le régler.<\/li>\n<\/ol>\n
